Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the houseclearancedurham.com website (the "Service") and booking any clearance services operated by us ("us", "we", or "our").

Your access to the website and acceptance of our services are conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and customers who book our services.

1. Services Provided

We provide professional domestic and commercial clearance services, including but not limited to house, garage, loft, garden, and office clearances, as well as bereavement and probate clearances.

2. Quotes and Estimates

  • No-Obligation Quotes: All quotes provided via email, phone, or website contact forms are free and carry no obligation until a formal booking is confirmed.

  • Accuracy of Information: Quotes provided over the phone or online are provisional estimates based on the information, photos, or descriptions provided by you (the Customer).

  • Price Amendments: We reserve the right to amend the final price on-site if the volume, weight, or nature of the waste differs significantly from what was originally described or if access to the property is more difficult than stated.

3. Customer Obligations & Property Access

The Customer agrees to ensure the following conditions are met on the day of the scheduled clearance:

  • Access: Safe and unobstructed access to the property and the items to be cleared must be provided.

  • Parking & Permits: The Customer is responsible for securing legal parking or loading permits for our vehicles at the clearance location. Any parking fines incurred due to a failure to provide adequate parking or permits will be added to the final invoice.

  • Sentimental Items & Valuables: The Customer must remove all items of high value or sentimental importance that are not meant to be cleared prior to our arrival. While we make every effort to spot misplaced valuables, we accept no liability for items cleared in error that were left among the waste.

4. Hazardous Materials & Restricted Items

Unless explicitly agreed upon in writing prior to arrival, we do not clear hazardous materials. The Customer must notify us if the clearance involves any of the following:

  • Asbestos

  • Biological waste, raw sewage, or medical waste

  • Chemicals, solvents, oils, or unsealed paints

  • Gas canisters or explosive materials

If hazardous items are discovered during a clearance that were not previously disclosed, we reserve the right to refuse to clear those specific items or cancel the job entirely, and a call-out fee may apply.

5. Payments and Billing

  • Payment Terms: Payment is due immediately upon completion of the clearance unless prior commercial credit agreements have been established in writing.

  • Payment Methods: We accept payment via Bank Transfer (BACS), Cash, Credit/Debit Card.

  • Invoices: A full invoice, along with standard waste disposal documentation (where applicable), will be issued upon receipt of payment.

6. Cancellations and Postponements

We understand that plans change. However, because we block out specific time slots and dispatch vehicles, the following cancellation policy applies:

  • More than 48 hours notice: No cancellation fee.

  • 24 to 48 hours notice: A cancellation fee of [e.g., 20% / £50] may be charged.

  • Less than 24 hours notice or on-the-day refusal: A full call-out fee of [e.g., 50% / £100] will be charged to cover fuel and staff deployment costs.

7. Waste Disposal & Recycling

  • Environmental Duty of Care: We operate strictly in accordance with UK Environment Agency regulations. We pledge to recycle, reuse, or donate as much of the cleared material as possible to minimize landfill waste.

  • Waste Transfer Notes: Where legally required for commercial or specific domestic clearances, a Waste Transfer Note will be provided to the customer as proof of legal disposal.

8. Limitation of Liability

  • We carry full Public Liability Insurance to protect your property during the clearance process.

  • We are not liable for any structural or cosmetic damage to the property that occurs while moving heavy, awkward, or bulky items through tight or restricted spaces, provided our team exercised reasonable care.

  • We accept no liability for financial losses resulting from delays caused by circumstances beyond our reasonable control (e.g., severe weather, vehicle breakdowns, or extreme traffic).

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
